An individual aged 21 years or older can be charged with a DWI if their blood alcohol concentration registers at 0.08% or higher. Since Texas is a zero-tolerance state, those who are under 21 years old can be charged if any trace of alcohol is detected in their system. These charges should not be taken lightly as penalties can range from mild to severe, including imprisonment of up to six months for a first offense.

The penalties for a DWI in Texas are:

  • 1st offense: Jail time can range from three days to six months with a maximum fine of up to $2,000. Penalties are more severe for those with a BAC of 0.15% or higher
  • 2nd offense: A minimum of 30 days in jail, and up to a maximum of one year, with a fine of up to $4,000
  • 3rd offense: Two to ten years in jail, in addition to a fine of up to $10,000
