Drug Classification in Texas
Texas divides illegal drugs into four penalty groups. Drugs in each group are penalized differently, depending on the circumstances and the amount in possession. Furthermore, an individual can be charged with drug possession with intent to distribute, which can carry severe penalties, including life in prison.
The four penalty groups are as follows:
- Group 1: Includes opioids, opium, opiates, cocaine, methamphetamine, ketamine, LSD, and other hallucinogens.
- Group 2: Includes ecstasy, PCP, hashish, and other derivatives of cannabis
- Group 3: Includes other opioids not classified in group 1, benzodiazepines, sedatives, anabolic steroids, methylphenidate (Ritalin), and other prescription drugs.
- Group 4: Includes other prescription drugs not found in group 3 and other chemical substances that can be potentially abused.
Marijuana Possession Laws
While other states have legalized recreational marijuana use, it is still illegal in the state of Texas, with the exception of medical cannabis. Individuals caught with marijuana can face severe punishments, even for a small amount. For example, if you are caught with less than two ounces, you can face a maximum jail sentence of 180 days in addition to paying a fine of up to $2,000.
